Intellectual Property Rights
This Intellectual Property Rights Policy (the "Policy") applies to all users of the Shopify store https://lightlenslab.shop/ (the "Store"), including but not limited to merchants, customers, visitors, and third-party service providers (collectively, "Users"). Light Lens Lab (hereinafter referred to as "Merchant"), founded in 2018 in Shangrao, China, is dedicated to the research, development, and manufacturing of high-quality photographic equipment such as camera lenses. By accessing or using the Store, you acknowledge and agree to comply with all provisions of this Policy, as well as applicable intellectual property laws, Shopify’s Terms of Service and Acceptable Use Policy.
1. Definitions
1.1 "Intellectual Property" or "IP" means all intellectual property rights recognized under applicable law, including but not limited to copyrights, trademarks, service marks, trade names, trade dress, patents, trade secrets, and any other proprietary rights in creative works, symbols, designs, logos, slogans, code, and other intangible assets, particularly those related to camera lenses, optical technology, and photographic equipment.
1.2 "Store IP" means all Intellectual Property owned or licensed by the Merchant, including but not limited to the Store’s domain name (https://lightlenslab.shop/), the "Light Lens Lab" brand name, logo, brand identity, product descriptions, lens design drawings, product images, videos, graphics, website design, code, and any other original content created for or used in connection with the Store’s camera lenses and related products (such as lens hoods and other accessories).
1.3 "Shopify IP" means all Intellectual Property owned by Shopify Inc. and its affiliates, including but not limited to the Shopify platform, software, documentation, applications, tools, templates, trademarks (such as "Shopify" and "Shop Pay"), and any modifications or enhancements thereto. This Policy does not alter the ownership or license terms of Shopify IP as set forth in Shopify’s official agreements.
1.4 "Third-Party IP" means Intellectual Property owned by third parties, including but not limited to suppliers, manufacturers, artists, and other content creators, which may be used in connection with the Store’s products or services (e.g., third-party lens technology patents, copyrighted images of photographic equipment). The Merchant strictly abides by the principle of intellectual property protection and ensures that all use of Third-Party IP is legally authorized.
2. Ownership of Intellectual Property
2.1 Store IP Ownership: The Merchant retains exclusive ownership of all Store IP. All rights, title, and interest in and to the Store IP, including any modifications, adaptations, or derivative works thereof (such as improved lens designs and updated product descriptions), shall remain with the Merchant at all times. This includes all intellectual property rights related to the Merchant’s self-developed camera lenses (e.g., Light Lens Lab 75mm f/2 "SP-II" and 35mm f/1.4 Aspherical "11873") and related research and development achievements.
2.2 Shopify IP Ownership: Shopify Inc. retains exclusive ownership of all Shopify IP. The Merchant and other Users are granted a limited, non-exclusive, revocable, non-sublicensable, non-transferable license to access and use the Shopify IP solely for the purpose of using the Shopify platform and operating the Store in compliance with Shopify’s Terms of Service. No rights in the Shopify IP are granted other than the limited license expressly set forth herein. The Merchant shall not engage in any act that infringes on Shopify’s IP, such as copying platform templates or code.
2.3 Third-Party IP Ownership: All Third-Party IP used in the Store (including but not limited to product brands, copyrighted images, and licensed optical technology) remains the exclusive property of the respective third-party owners. The Merchant shall ensure that all use of Third-Party IP is authorized by the applicable owner, whether through a license, permission, or other legal right, and shall comply with all terms and conditions governing such use. The Merchant has established a sound intellectual property management system to avoid disputes arising from unclear ownership of third-party IP.
3. Permitted Use of Intellectual Property
3.1 Permitted Use of Store IP: Customers and visitors may view, download, and print content from the Store solely for personal, non-commercial use (e.g., viewing product information for personal purchase reference), provided that such use does not infringe upon the Merchant’s IP rights or violate this Policy. No other use of Store IP (including but not limited to reproducing lens design drawings, using the "Light Lens Lab" logo for commercial promotion, or reselling the Merchant’s product images) is permitted without the Merchant’s prior written consent.
3.2 Permitted Use of Shopify IP: Users may use Shopify IP only as authorized by Shopify’s Terms of Service and Brand Usage Guidelines. Users shall not use Shopify’s trademarks, logos, or other brand assets in a manner that is misleading, harmful, or inconsistent with Shopify’s brand integrity, and shall not imply any affiliation, sponsorship, or endorsement by Shopify without express written authorization from Shopify.
3.3 Restrictions on Use: No User shall reproduce, duplicate, copy, sell, resell, distribute, modify, adapt, reverse engineer, decompile, disassemble, or exploit any IP (Store IP, Shopify IP, or Third-Party IP) for any commercial purpose without the express written permission of the respective IP owner. This includes but is not limited to reverse engineering the Merchant’s camera lenses, copying lens optical design technology, or using the Merchant’s brand to sell counterfeit products. Additionally, Users shall not use any IP in a manner that violates applicable law, infringes upon the rights of others, or harms the reputation of the Merchant, Shopify, or any third party.
4. Intellectual Property Infringement
4.1 Prohibition on Infringement: The Merchant shall not post, upload, display, or offer for sale any products, content, or materials that infringe upon the IP rights of any third party. This includes but is not limited to counterfeit camera lenses, copyrighted content (such as product images and lens design documents) used without permission, and unauthorized use of trademarks or trade dress. The Merchant strictly prohibits the sale of counterfeit or infringing photographic equipment and has established a pre-inspection mechanism for products to ensure compliance with intellectual property laws.
4.2 Reporting Infringement: If you believe that any content or products in the Store (https://lightlenslab.shop/) infringe upon your IP rights, please submit a written infringement notice to the Merchant containing the following information (consistent with Shopify’s infringement reporting requirements and relevant Chinese and international intellectual property regulations):

Your full legal name, contact information (address, email, and phone number), and proof of ownership of the infringed IP (e.g., trademark registration certificate, copyright registration, patent certificate, or other evidence of ownership);

A detailed description of the infringed IP, including the specific elements (e.g., logo, text, lens design, patent technology) that are being infringed;

Direct links to the specific content or products in the Store (https://lightlenslab.shop/) that you believe infringe your IP;

A statement that you have a good faith belief that the use of the content or products in the manner complained of is not authorized by the IP owner, its agent, or the law;

A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the IP owner or authorized to act on behalf of the IP owner;

Your physical or electronic signature.
4.3 Response to Infringement Notices: Upon receipt of a valid infringement notice, the Merchant shall promptly investigate the alleged infringement (usually within 3-5 working days). If the Merchant determines that the content or products do infringe upon the complainant’s IP rights, the Merchant shall take immediate action to remove or disable access to the infringing content or products, and may terminate any accounts or relationships associated with the infringement. The Merchant reserves the right to request additional information from the complainant or the alleged infringer to resolve the matter. The Merchant will record and retain all relevant information related to the infringement investigation in accordance with regulations, with a retention period of not less than three years from the date of handling.
4.4 False or Bad Faith Notices: The submission of false or bad faith infringement notices is prohibited and may subject the submitter to legal liability, including damages and attorneys’ fees. The Merchant reserves the right to reject any notice that is incomplete, inaccurate, or submitted in bad faith, and may pursue legal liability against the submitter for any losses caused thereby.
5. User-Generated Content
5.1 If you submit, post, or upload any user-generated content (including but not limited to reviews, comments, photos, or videos of camera lenses) to the Store, you represent and warrant that you own all IP rights in such content, or that you have obtained all necessary permissions from the applicable IP owners to submit, post, or upload such content. You grant the Merchant a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with the Store and the Merchant’s business (e.g., using user reviews to promote products).
5.2 The Merchant reserves the right to remove any user-generated content that infringes upon the IP rights of others, violates this Policy, or is otherwise inappropriate (e.g., content involving counterfeit lens reviews or infringement of third-party copyrights).
6. Enforcement
6.1 The Merchant reserves the right to enforce its IP rights to the fullest extent permitted by law, including but not limited to sending cease-and-desist letters, filing legal claims, and seeking damages for IP infringement. The Merchant may also cooperate with law enforcement authorities to investigate and prosecute IP infringement, especially in cases of serious infringement such as counterfeiting the Merchant’s camera lenses or stealing lens design patents.
6.2 Shopify reserves the right to take action against any Store or User that violates Shopify’s IP policies, including but not limited to suspending or terminating access to the Shopify platform, in accordance with Shopify’s Terms of Service. The Merchant shall actively cooperate with Shopify’s intellectual property enforcement actions to ensure the legitimate operation of the Store.
7. Changes to This Policy
The Merchant reserves the right to update or modify this Policy at any time. Any changes to this Policy will be posted on the Store’s website (https://lightlenslab.shop/), and the effective date of the updated Policy will be indicated at the top of the page. Your continued use of the Store after the updated Policy is posted constitutes your acceptance of the changes.
